Terms of Use

Welcome to journelism, a site at journelism.org, and all linked pages (”Site”) which is owned and operated by EDUCATION FOR THE FUTURE LLC, which is owned and operated by EDUCATION FOR THE FUTURE LLC, a nonprofit entity based in Michigan.  The materials on the Site are owned in their entirety by EDUCATION FOR THE FUTURE LLC.  The Site may also include materials owned by third parties and posted on the Site by virtue of a license, grant or some other form of agreement between the third party and EDUCATION FOR THE FUTURE LLC.

You are only authorized to access this Site or to use the materials contained in the Site (regardless of whether your access or use is intended) if you agree to abide by all applicable laws, and to these Terms of Use which constitute an Agreement between you and journelism. Please read these Terms of Use carefully and save them. If you do not agree with them, you should leave this Site immediately

journelism reserves the right to modify or amend this Agreement without notice at any time.

Access and Use

All materials contained in this Site are protected by both international trademark and copyright laws and the laws of the United States of America. The reproduction, duplication, distribution (including by way of email, facsimile or other electronic means), publication, modification, copying or transmission of material from this Site is STRICTLY PROHIBITED unless you have obtained the prior written consent of journelism and its legal counsel or unless it is expressly permitted by this Site. The material covered by this prohibition includes, without limitation, any text, graphics, logos, photographs, audio or video material or stills from audiovisual material available on this Site.

You are also strictly prohibited from creating works or materials that derive from or are based on the materials contained in this Site including, without limitation, fonts, icons, link buttons, wallpaper, desktop themes, on-line postcards and greeting cards and unlicensed merchandise. This prohibition applies regardless of whether the derivative materials are sold, bartered or given away.

The Site may provide you with the chance to upload or provide success stories, anecdotes messages, photos, videos, clips, ideas, feedback, comments or other content (“Content”). You understand and agree that journelism has the right in its sole discretion, but not the obligation, to monitor, edit, and remove any posted Content, and assumes no liability for any such Content. You warrant that you own or otherwise control all of the rights to such Content, that you are not violating any law by uploading or posting Content to the Site, that it is accurate, and that its use does not violate these terms and will not injure any person or entity. You further agree not to upload, post or otherwise make available Content that is protected by a third party’s copyright, trademark or other proprietary right without the express permission of the third party owner of the copyright, trademark or other proprietary right. You shall be solely liable for any damage resulting from any infringements on third party rights resulting from your submission of such Content.

You agree that your uploading and/or transmittal of Content does not violate any of provisions set forth under the “Bulletin Boards and Chat Rooms” section of these terms. If you upload or transmit Content, you grant to journelism a non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable right to use, reproduce, modify, publish, translate, create derivative works (including products) from, distribute, and display such Content, in whole or in part, throughout the world in all media. You grant to journelism the right to use the name that you submit in connection with such Content.

You agree that any Content that you submit shall be considered non-proprietary and non-confidential. journelism shall have no obligations of any kind with respect to any Content and shall be free to reproduce, use, disclose and/or distribute any Content for any purpose whatsoever, without limitation. You also agree that journelism shall be free to use any ideas, concepts or techniques embodied in the Content for any purpose whatsoever, including, but not limited to, producing, developing and marketing news stories, shows, movies, content of any kind, products or services incorporating such ideas, concepts, or techniques, without attribution. In addition, you hereby waive all moral rights you may have in any materials uploaded or sent to us by you.

Bulletin Boards and Chat Rooms

You are welcome to post, transmit or submit messages and other materials (which include uploading files, inputting data or any other materials or engaging in any form of communication in connection with this Site) (collectively “Messages”) to bulletin boards, chat rooms or other public areas within, or in connection with, this Site.  However, journelism accepts no responsibility whatsoever in connection with or arising from such Messages. In addition, children under the age of 13 are not authorized to post Messages or participate in forums on this site.

journelism assumes no responsibility for actively monitoring the Site for inappropriate Messages. If at any time journelism chooses, in its sole discretion, to monitor the Site, journelism nonetheless assumes no responsibility for the content of the Messages, no obligation to modify or remove any inappropriate Messages, and no responsibility for the conduct of the user submitting any Message. In submitting Messages to the Site, you agree to strictly limit yourself to discussions about the subject matter for which the Site is intended. You agree that journelism accepts no liability whatsoever if it determines to prevent your Messages from being submitted or if it edits, restricts or removes your Messages.

You agree that you will not submit Messages to the Site that:

• are unlawful, threatening, obscene, vulgar, pornographic, profane or indecent including any communication that constitutes (or encourages conduct that would constitute) a criminal offense, gives rise to civil liability or otherwise violates any local, state, national or international law;

• violate the copyright, trademark or other intellectual property rights of any other person;

• improperly assume or claim the identity, characteristics or qualifications of another person;

• are for purposes of spamming;

• contain any virus or other harmful component;

• are libelous, or an invasion of privacy or publicity rights or any other third party rights; or

• are for commercial purposes or contain advertising or are intended to solicit a person to buy or sell services or to make donations.

You agree that any Message whatsoever submitted by you becomes the property of journelism and may be used, copied, sublicensed, adapted, transmitted, distributed, publicly performed, published, displayed or deleted as journelism sees fit.

You agree to release journelism, its parents and affiliates together with their respective employees, agents, officers, directors and shareholders, from any and all liability and obligations whatsoever in connection with or arising from your use of the Site.

Linked Sites and Advertising

If you are interested in creating hypertext links to this Site, you must contact journelism before doing so. In establishing hypertext links, you must not represent in any way, expressly or by implication, that you have received the endorsement, sponsorship or support of this Site, including its respective employees, agents, directors, officers and shareholders.

journelism is not responsible for the content or practices of third party web sites that may be linked to this Site. journelism takes no responsibility for third party advertisements which are posted on this Site, nor does it take any responsibility for the goods or services provided by its advertisers.

Disclaimer of Liability and Warranties

You agree that you will use this Site and rely on material contained in this Site at your own risk.

The Site, and all materials in this Site, are provided “as is” and, to the fullest extent permitted by law, are provided without warranties of any kind either express or implied. This means, without limitation, that journelism DOES NOT WARRANT that the Site is fit for any particular purpose; that the functions contained in the materials in the Site will be uninterrupted; that defects will be corrected; that the Site is free of viruses and other harmful components or that the Site is accurate, error free or reliable.

You acknowledge that journelism and third party content providers, their parents and affiliates together with their respective employees, agents, directors, officers and shareholders, ARE NOT LIABLE for any delays, inaccuracies, failures, errors, omissions, interruptions, deletions, defects, viruses, communication line failures or for the theft, destruction, damage or unauthorized access to your computer system or network.

You acknowledge that journelism is not liable for any defamatory, offensive or illegal conduct or material found in connection with this Site, including such conduct or material transmitted by any means by any other person.

With respect to any Content provided by users or other submissions, journelism is merely a distributor of such Content. journelism is not responsible for any Content submitted by users or other third parties, including their opinions, judgments, advice, statements, services or other information provided. journelism shall not be liable for any loss or damage caused by any reliance upon such information obtained through the Website. It is your responsibility to evaluate the accuracy, completeness, or usefulness of any Content.

Indemnity

You agree to defend, indemnify and hold harmless journelism, its parents and affiliates together with their respective employees, agents, directors, officers and shareholders, from and against all the liabilities, claims, damages and expenses (including reasonable attorney’s fees and costs) arising out of your use of this Site; your failure to use the Site; your breach or alleged breach of this Agreement or your breach or alleged breach of the copyright, trademark, proprietary or other rights of third parties.

Termination

journelism reserves the right to immediately terminate your use of, or access to, this Site at any time if journelism decides at its sole discretion that you have breached this Agreement or any relevant law, rule or regulation or you have engaged in conduct that journelism considers to be inappropriate or unacceptable.

Other

This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.

This Agreement is governed by, and construed in accordance with, the laws of the State of Michigan without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts of the State of Michigan or, if appropriate, the United States District Court for the Eastern District of Michigan for resolution of any dispute, action or proceeding arising in connection with this Agreement or your use or non-use of the Site, and you further irrevocably waive any right you may have to trial by jury in any such dispute, action or proceeding.

Privacy Policy

journelism has adopted a Privacy Policy which describes how journelism collects, uses and shares personally identifiable information (“PII”) while you are on the journelism website and when you use journelism services.

journelism is a general audience web site, and does not knowingly collect PII from children under 13 years of age.

Information You Provide to Us:

journelism collects personally identifiable information (”PII” — that is, information such as your full name, email address, mailing address or telephone number) only in order to create or enhance our relationship with you. When we collect PII from you, it is because you voluntarily submit the information to us in order to participate in activities like sweepstakes, contests, games, surveys, forums, subscription registrations, chats or bulletin boards, in connection with content or suggestions you submit to us or because you want us to furnish you with products, services or information. We may also obtain PII from third parties.

How Does journelism Use My Information?

Social sharing of User Content: journelism allows other users to browse stories that you have written, edited, or commented on. This information is made available via your member profile or within the article or history page of the story in which you performed the action on. journelism may choose to post this data on other site features in the future.

Profile information: journelism allows other users to browse your full name, email address and blog URL within your member profile should you provide this optional information.

Syndication: journelism allows for the RSS syndication of all of its public content within the website.

API: journelism may allow third parties access to all journelism data that is already publicly available through journelism.com through an application program interface that allows other programs to interact with our site. journelism will keep passwords and blog settings private.

Will journelism Share Any of the Information it Receives?

When you provide your PII to journelism , journelism will only share such PII with companies known and trusted by journelism.

journelism’s web site may be linked to Internet sites operated by other companies. Some of these third party sites may be co-branded with a journelism logo, even though they are not operated or maintained by journelism.

journelism’s web site also carries advertisements from other companies. journelism is not responsible for the privacy practices of web sites operated by third parties that are linked to our site(s) or for the privacy practices of third party or national Internet advertising companies. Once you’ve left a journelism site via such a link or by clicking on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine how they will handle any PII they collect from you.

journelism’s web site(s) may also be linked to sites operated by companies affiliated with journelism. Although all companies affiliated with journelism adhere to this website’s privacy policy visitors to those affiliated sites should still refer to their separate privacy policies and practices, which may differ in some respects from this policy.

Some of the advertisements that appear on journelism’s web site(s) are delivered to you by Internet advertising and application companies such as Yahoo and Google. These companies ultilize certain technologies to deliver advertisements and marketing messages and to collect anonymous information about your visit to our site(s), including information about the banner ads they display, any cookie they place on your computer and your IP address.

journelism will not use the PII you provide to us for purposes different from the purpose for which it was submitted or share your PII with third parties that are not affiliated with journelism, unless we obtain your permission.

journelism will use your PII provided under this policy in a manner that is consistent with this policy. If journelism obtains PII from a third party, such as a business partner, our use of that information is governed by this policy.

journelism may share your PII with companies that are affiliated with it. journelism may also share your PII with advertisers and business partners that are not affiliated with journelism, but would like to send you information about their products and services.

journelism employees, agents and contractors must have a legitimate business reason to obtain access to your PII. journelism may share your PII with outside contractors or agents who help us manage our information activities, but they may only use your PII to provide journelism with a specific service and not for any other purpose.

journelism may also enter into agreements with outside companies that possess the technology that allows journelism to customize the advertising and marketing messages you receive on our web sites. Your non-PII and click stream data about your activities on our sites may be shared with these companies so this customization can be accomplished. These companies will not share your information with any third party or use it for any other purposes. Anonymous click stream and demographic information may also be shared with journelism’s advertisers and business partners.  There may be instances when journelism may disclose PII without providing you with a choice in order to protect the legal rights of journelism, other companies or their employees, agents and contractors; to protect the safety and security of visitors to our web sites; to protect against fraud or for risk management purposes; or to comply with the law or legal process. In addition, if journelism sells all or part of its business or makes a sale or transfer of assets or is otherwise involved in a merger or business transfer, journelism may transfer your PII to a third party as part of that transaction.

journelism uses reasonable administrative, technical, personnel and physical measures to safeguard PII in its possession against loss, theft and unauthorized use, disclosure or modification. In addition, journelism uses reasonable methods to make sure that PII is accurate, up-to-date and appropriately complete.

Cookies.

Cookies are small bits of information that the journelism web site places on the hard drive of your computer. Cookies remember information about your activities on our site and enable journelism to make your visits more enjoyable. For example, cookies can store a password for easy logon to a site you have previously visited, can save your preferences for a personalized home page or can track the items you have placed in your “shopping cart” during a visit to an online store.

Third party advertisements may also contain cookies set by Internet advertising companies or advertisers. journelism does not control these advertiser cookies and visitors to our web site(s) should check the privacy policy of the Internet advertising company or advertiser to see whether and how it uses cookies.

journelism may use cookies and similar tools to relate your use of our web site(s) to PII obtained from you or a third party. For example, if you’ve asked us to provide you information about an upcoming product or promotion, cookie and/or click stream data about your activities on journelism may allow journelism to limit the materials provided to you, based on your prior online activities and preferences.

You can program your computer to warn you each time a cookie is being sent or to refuse cookies completely.

Changes to this Privacy Policy

journelism may amend this Privacy Policy from time to time, at our sole discretion. Use of information we collect is subject to the Privacy Policy in effect at the time such information is used. If we make changes to the Privacy Policy, we will notify you by posting an announcement on the journelism website so you are always aware of what information we collect, how we use it, and under what circumstances if any, it is disclosed.
